In accordance with the provisions of the "Federal Law on the Protection of Personal Data Held by Private Parties," the legal entity "Preserve LTD, S.A. de C.V.," a company legally incorporated under Mexican law, with its registered address at: Avenida 2, No. 10, Colonia Parque Industrial Cartagena, C.P. 54900, Tultitlan, State of Mexico, website preservemx.com, is responsible for the use and protection of your personal data, and in this regard, we inform you of the following:

Purposes for the Use of Your Personal Data

We will use the personal data we collect from you for the following purposes, which are necessary for the service you request:

    • General Data: To verify your identity, locate you, send you communications regarding our service, contact you, send you information relevant to the legal relationship, send you information you have requested, as well as anything related to activities and events connected to the services we provide in order to fulfill obligations to our customers, evaluate service quality, conduct internal studies on consumption habits regarding our products and services, and address complaints and inquiries.
    • Financial Data: Data for the processing, operation, and administration of billing and collection arising from the contractual relationship or from activities resulting from the services provided, as well as references for granting credit.

Personal data pertaining to legal entities or individuals engaged in business activities are not subject to the LFPDPPP and its regulations; however, we are informing you of how such data is processed.

Additionally, we inform you that your data will be used solely for the purposes of the legal relationship and will not be used for secondary purposes.

To carry out the purposes described in this privacy notice, we will use the following personal data:

  • General Data: First name or business name, last name(s), signature, photo ID, Unique Population Registry Code (CURP), work and personal phone numbers (both landlines and cell phones), complete address (whether residential or business), personal or work email address, voter ID card (INE), personal references, data obtained from public sources, video recordings, audio recordings, and all data generated by the legal relationship. In the case of legal entities, the relevant documents and official information to verify such status.
  • Financial Information: Federal Deceased Persons Registry, Advanced Electronic Signature Serial Number, Social Security Number and/or Employer Registration Number, and tax documents necessary for the legal relationship, credit references, amounts owed, debtors, creditors, credit bureau, commercial references, banking references, financial statements, numbers linked to bank accounts, name of the account or cardholder, account number and originating bank, CLABE (if applicable), and all data generated by the legal relationship itself. All of this data is stored with your express consent and is necessary for the legal relationship.

 

The personal data collected by Preserve LTD, S.A. de C.V. is protected by appropriate security, administrative, and physical measures against damage, loss, alteration, destruction, unauthorized use, access, or processing, in accordance with the provisions of the LFPDPPP and its regulations.

Transfers of Your Personal Information and Their Purposes. We inform you that, in connection with the contracting and performance of certain services necessary for the fulfillment of the legal relationship established with you, your personal data may be transferred to third parties, both within and outside the country, with whom Preserve LTD, S.A. de C.V. has contracted to perform certain tasks related to the services it provides to its clients. These third parties may process your personal data under the instructions of Preserve LTD, S.A. de C.V., or make decisions regarding it as part of the legal relationship. In this regard, Preserve LTD, S.A. de C.V. informs you that, in the course of providing its services, it may transfer your personal data to:

a) The company’s business partners for the purpose of enabling such partners to offer, manage, and operate the direct or complementary services you have contracted.

b) Non-affiliated third parties who provide auxiliary or complementary services, including commission agents, agents, intermediaries, brokers, promoters, data processing companies, courier companies, security and cash-in-transit companies, IT and computer systems specialists, information storage and custody companies, facilities management, analytics, accounting, and legal advisors.

d) Transfers to comply with legal obligations. Your personal data may be transferred to third parties, whether domestic or foreign, when such data disclosure is provided for by law or treaty, at the request of the authorities, and when required by a resolution of a competent authority.

Your Rights Regarding Your Personal Data

You have certain rights regarding your data, known as ARCO rights. You have the right to know what personal data we hold about you (Access), why we use it, and the conditions under which we process it, (Rectification) to have it corrected if it is outdated, inaccurate, or incomplete, (Deletion): to have it removed from our records or databases when you believe it is not being used in accordance with the principles, duties, and obligations set forth in the regulations; as well as (Objection): to object to the use or disclosure of your personal data for specific purposes. You may exercise any of these options; In addition, you may restrict the use or disclosure of your personal data; you may at any time object to the secondary processing of your data or revoke the consent you have granted us regarding your personal data by submitting a written request to our personal data department, exercising any of your ARCO rights at the following address: Avenida 2, No. 10, Colonia Parque Industrial Cartagena, Zip Code 54900, Tultitlán, State of Mexico, Monday through Thursday from 8:00 a.m. to 5:30 p.m. and Friday from 8:00 a.m. to 2:30 p.m., addressed to the Personal Data Department.

Such a request must include the following: (I) Name of the data subject, (II) Email address for receiving notifications, (III) Documents proving the data subject’s identity or, where applicable, proof of legal representation for natural persons; for legal entities, proof of authority must be provided via a notarized power of attorney or a power of attorney signed before two witnesses, along with their identification documents, (IV) A clear and precise description of the personal data regarding which the right is being exercised and the right being asserted, (V) Any other information or document that facilitates the location of the personal data. If the request does not meet any of the requirements listed above, the Personal Data Department may, within 5 business days of receiving the request, ask you to provide the necessary information or documents to process it. (VI) Provide an email address to receive the response to your request.

The response times for exercising your rights are those stipulated by the Federal Law on the Protection of Personal Data Held by Private Parties and its Regulations.

Exercising your rights is free of charge. However, you may be required to cover reasonable shipping costs or the cost of reproducing copies or other formats. Similarly, if the same person submits a repeat request within a period of less than twelve months, the costs will not exceed three days’ worth of the General Minimum Wage in effect in Mexico City, unless there are substantial modifications to the privacy notice that give rise to new inquiries.

Use of Tracking Technologies on Our Website
